1. Acceptance of Terms

By downloading, installing, or using any mobile application published by Kowanz Media, SL ("we", "our", or "us"), a company established in Andorra la Vella, Andorra (TIN: L-719319-J), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Kowanz Media provides mobile applications for English language learning (the "Service"). The Service includes all features, content, and functionality made available through our applications.

The Service is provided "as is" and may be modified, updated, or discontinued at any time without prior notice.

3. User Accounts

Some features of the Service may require you to create an account. You agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service to transmit harmful, offensive, or objectionable content
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated means (bots, scrapers, etc.) to access the Service
  • Reproduce, distribute, or create derivative works from the Service without our written permission

5. Intellectual Property

The Service and all its contents, including but not limited to text, graphics, logos, icons, audio, video, software, and learning materials, are the property of Kowanz Media, SL or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes, subject to these Terms.

6. Subscriptions and Payments

Some features of the Service may be available through paid subscriptions or in-app purchases. By making a purchase, you agree to the following:

  • Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period
  • You can manage and cancel subscriptions through your device's app store settings
  • Refunds are handled by the respective app store according to their policies

7. User-Generated Content

If you submit, post, or create content within the Service, you retain ownership of that content. However, you grant Kowanz Media, SL a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing and improving the Service.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Any defects will be corrected
  • The educational content will result in any specific learning outcomes
  • The Service is a substitute for formal language instruction or certification

9. Limitation of Liability

To the maximum extent permitted by applicable law, Kowanz Media, SL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from:

  • Your use of or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Any third-party conduct on the Service
  • Any other matter related to the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty US dollars (USD $50), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kowanz Media, SL, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service or violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Principality of Andorra, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of Andorra.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and associated data in accordance with our Privacy Policy
  • Sections related to intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app or by other reasonable means. The "Last updated" date at the top indicates the most recent revision.

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
